General Terms & Conditions of the e-commerce site

I. SUMMARY

  1. PRICE: Our prices and discounts are specified on our e-commerce site. They can be modified at any time.
  2. PAYMENT: All our goods are paid and invoiced at the time of order.
  3. TAXES: Import fees or taxes due in the country of delivery are not included in our prices. The VAT due will be the VAT of current legislation.
  4. COLLECTION OR TRANSPORT: The conditions of collection or transport are determined at the order according to the customer's choice.
  5. DAMAGE: In case of damage to the goods during transport, the customer must make observations in writing on the delivery note upon receipt of the goods.
  6. MESSAGE: Messages must be sent by e-mail to the customer's address or to our address hello@cielbelge.com.
  7. DELIVERY TIME: Delivery times are specified on the e-commerce site for each product.
  8. WAIVER: The customer may renounce his order in whole or in part under the conditions set out in the detailed terms & conditions.
  9. ON-COMPLIANCE: In case of non-conformity of a product, the customer can renounce the nonconforming goods and obtain a full refund of the price, under the conditions listed in the detailed terms & conditions.
  10. LIABILITY: We limit our liability to the refund and indemnities provided for in the detailed terms & conditions.
  11. RETURNABLE PACKAGING: All packaging directly containing our products is returnable.
  12. APPLICABLE LAW AND TRIBUNALS: All our contracts are governed by Belgian law, and in the event of a dispute, the courts of Brussels have sole jurisdiction.
  13. PRIVACY POLICY : By using the site, the customer agrees to our privacy policy.


II. GENERAL TERMS & CONDITIONS DETAILED

  1. PRICE
    1. Our prices and discounts are specified on our e-commerce site.
    2. They can be modified at any time.
    3. The prices indicated on a quotation or on a dated document from our website will remain valid for two months for the customer who takes advantage of it.
  2. PAYMENT: All our goods are paid for and invoiced at the order.
    In the case of payment by credit or debit card, the card is debited upon confirmation.
  3. TAXES: Import charges or taxes due in the country of delivery are not included in our prices.
    1. The VAT due will be the VAT of current legislation. 
    2. If the customer has an intra-community VAT number, he can ask us an invoice without VAT.
    3. Customers with exemptions such as members of embassies can benefit from VAT-free invoicing only on presentation of the document issued by the embassy or consulate to which they belong.
    4. Customers who export the goods purchased from us must pay the pro forma invoice with VAT. The refund of the VAT amount will be made upon receipt of the export documents. For this purpose, the customer shall provide us with his full bank details (IBAN and Swift).
  4. COLLECTION OR TRANSPORT: The conditions of collection or transport are determined at the order according to the customer's choice.
  5. DAMAGES
    1. Notification: In case of damage caused to the goods during transport, the customer must make reservations in writing on the delivery note upon receipt of the goods.
    2. Reservations expressed in writing regarding apparent damage must be precise and detailed.
    3. A photo of the damage will be sent to us by e-mail.
  6. MESSAGES: Messages must be sent by e-mail to the customer's address or to our address hello@cielbelge.com.
  7. DELIVERY TIME: Delivery time is specified on the e-commerce site for each product. The date mentioned on the site and on the order form is an indication and will be confirmed or specified when processing the order or payment. For goods in stock, it may exceptionally happen that the goods are no longer available because of sale on the same day. In this case, we will notify the customer by a message.
  8. WAIVER: The customer may renounce his order in whole or in part under the following conditions:
    1. Refund: The amount paid will be fully refunded for a stock product. A product on demand with a lead time higher than ten days will be refunded at 70% of the amount paid. A custom-made product will be refunded at 60% of the amount paid. The refund will be made in the form of a voucher on our e-commerce site.
    2. Samples and products of less than one unit of measurement (1 kg, 1 liter, 1m²) will not be refunded. Before ordering a large quantity of an unfamiliar product, the customer should always order a sample.
    3. Short delay and notification: The renunciation must be signaled by a message before expedition or within a maximum of fifteen days after collection or receipt. The return of the goods to our warehouse within the short time limit shall be deemed to be a notification.
    4. Return: The products that the customer renounces after delivery must be returned at the customer's expense to our warehouse at Business Park, 21 den Horick, 3090 Overijse, Belgium properly packaged and in good condition, within the delay for renunciation. If the client asks us, within the short time limit for the notification of the waiver, to organize this return, an quote will be proposed to him, and in case of acceptance, the return costs will be deducted from the refund.
    5. Non-compliance with the conditions: in case of non-compliance with the above conditions, the goods will not be refunded.
  9. NON-CONFORMITY: In case of non-conformity of a product, the customer will be able to renounce the non-conforming goods and obtain a full refund of the price under the following conditions:
    1. Tolerances: Non-conformity must be assessed according to the particular characteristics and tolerances of our products.
    2. Refund: The refund will be paid into the customer's bank account.
    3. Short delay and notification:
      1. Our goods must be checked on the day of collection or upon receipt, and any apparent non-conformity problems must be reported to us by a message on the day of receipt.
      2. If the non-conformity cannot be found at collection or delivery, the non-conformity must be reported by message within a maximum of fifteen days after delivery, stating the reasons that prevented a more rapid report.
      3. If the non-conformity could not appear before a certain period of time, it must be reported to us by a message as soon as it appears, explaining in detail its appearance.
      4. The return of goods to our warehouse within the time limit shall be deemed as a notification.
    4. Pictures: The report must be gone along with general and detailed pictures and, if possible, a sample of the non-conforming product must be sent.
    5. Visits: We do not visit a customer's place to notice installation errors or conformity problems.
    6. Returns: Non-conforming products must be returned, within a maximum period of fifteen days after notification, to our warehouse at Business Park, 21 den Horick 3090 Overijse Belgium, suitably packaged and in good condition, before refund.
      1. In case of agreement over the return modalities, the return costs will be at our expense and will be refunded to the client.
      2. If non-conformity is not confirmed, but the conditions for a waiver are still met, the customer may obtain a refund under the above-mentioned conditions for a waiver. The return costs will not be refunded.
      3. If non-conformity is not confirmed, and the conditions of a waiver are no longer met, the customer will no longer be able to obtain a refund of the goods.
    7. Indemnity: An indemnity of 10% of the price of the non-conforming goods will be paid to the customer in the form of a voucher on our site. This compensation will be due unconditionally if the non-conformity is confirmed, even if the customer accepts the goods or if the conditions for refund are not met.
  10. LIABILITY
    1. We limit our liability to the refund and indemnities provided for above.
    2. Therefore, we do not accept any liability for any damage relating to the installation or repair of the substrate.
    3. We cannot guarantee the compatibility of our products with unusual or doubtful substrates.
    4. The installation is deemed to be an acceptance of the goods.
    5. For liquid products, the customer must imperatively check the conformity before opening the container. An open container whose content complies with the samples acquired separately or applied to the container, or complies with the descriptions on the label, will not be refunded.
  11. RETURNABLE PACKAGING. All packaging directly containing our products is returnable.
    1. Payment: The price of the deposit will be paid to the customer in the form of a voucher on our e-commerce site. Unless otherwise stated on the packaging, the deposit price is 0.5€ per packaging containing more than half a unit of measurement (>1/2kg or >1/2litre), and 1€ per packaging containing more than one unit of measurement (>1 kg or >1 liter).
    2. Deadline: The packaging must be returned within six months from the last delivery to the customer.
    3. Return: In our warehouse at Business Park, 21 den Horick, 3090 Overijse Belgium. If the client asks us to organize this return, a quotation will be proposed. The amount of the deposit will be calculated in our warehouse.
    4. Non-returnable: Packaging made of paper, cardboard or wood as well as packaging for shipping, stuffing material, or films, tapes and fastening ties are not refundable. However, they can be returned to us with the returnable packaging. All packaging will be processed by us for recycling.
  12. APPLICABLE LAW AND COURTS: All our contracts are governed by Belgian law, and in case of a dispute, the courts of Brussels shall have sole jurisdiction.
  13. PRIVACY POLICY
    1. Collection of information : We collect information when you register on our site, when you log in to your account, make a purchase and/or when you log out. The information collected includes your name, email address, phone number, and/or credit card information.
      In addition, we automatically receive and record information from your computer and browser, including your IP address, your software and hardware, and the page you request.
    2. Use of information : Any information we collect from you may be used to:
      - Personalise your experience and meet your individual needs
      - Improve customer service and your care needs
      - Contact you by email
    3. E-commerce privacy : We are the sole owners of the information collected on this site. Your personal information will not be sold, exchanged, transferred, or given to any other company for any reason, without your consent, other than what is necessary to fulfill a request and/or transaction, such as to ship an order.
    4. Disclosure to Third Parties : We do not sell, trade or otherwise transfer your personally identifiable information to third parties. This does not include trusted third parties who assist us in operating our website or conducting our business, so long as those parties agree to keep this information confidential.
      We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, or when required by law.
    5. Information Protection : We implement a variety of security measures to keep your personal information safe. We use state-of-the-art encryption to protect sensitive information transmitted online. We also protect your information offline. Only employees who need to perform a specific job (for example, billing or customer service) have access to personally identifiable information. The computers and servers used to store personally identifiable information are kept in a secure environment.
    6. Use of Cookies : Our cookies improve access to our site and identify repeat visitors. However, this use of cookies is in no way linked to any personally identifiable information on our site.
    7. Unsubscribe : We use the email address you provide to send you information and updates about your order, occasional company news, information about related products, etc. If at any time you wish to unsubscribe and no longer receive emails, the request can be made by email to rgpd@paonlin.com.
    8. Consent : By using our site, you consent to our privacy policy.


III. SPECIAL CONDITIONS FOR PAINTS

  1. NON-COMPLIANCE: In case of non-conformity of a product, the customer will be able to renounce the non-conforming goods and obtain a full refund of the price, under the conditions set out in the detailed general conditions.
    1. Tolerances: Non-conformity must be assessed according to the particular characteristics and tolerances of our products.
      1. For our paints, they adhere perfectly to most of common or prepared substrates and our tints are always as close as possible to a sample or a reference.
      2. Nevertheless, the human eye perceives finer shades than it is technically possible to produce. In addition, the texture of the paint, the color and state of the support, and the number of layers has an influence on the color rendering. Finally, some substrates may present compatibility problems with certain paints. Therefore, on a doubtful support or to evaluate a shade, it is essential to carry out a preliminary test using a sample of minimum size A4.
      3. In case of different batches, we recommend mixing the pots or painting a well-defined surface per batch. A touch-up should always be carried out on a well-defined surface.
      4. A Δ E of less than three on the same substrate with the same method of application is within our manufacturing tolerances.

    1. For liquid products, the customer must imperatively check the conformity before opening the container. An open container whose content complies with the samples acquired separately or applied to the container, or complies with the descriptions on the label, will not be refunded.
